Higo® is a multi-sensor device used for diagnostic support which digitally records the following medical data: images of the oral cavity, ear canal and skin, audio of the lungs, heart, abdomen, and cough, body temperature. The Higo® product is intended for use by both untrained operators at home and by qualified healthcare professionals in a clinical and ambulatory environment. The product is not intended for self-diagnosis. This is a medical device. Use it in accordance with the instructions for use or label. The manufacturer and advertiser is HigoSense Sp. z o.o.

By accessing this Website, you agree to be bound by these Website Terms and Conditions of Use (“T&C”), all applicable laws and regulations, including GDPR, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this Website. The materials contained in this Website are protected by applicable copyright, trademark, and intellectual property laws.
You may use the Website only for lawful purposes, including B2B inquiries about our remote care solutions. It is forbidden to use the Website:
- in any way which may lead to a violation of applicable law;
- in any manner that is unlawful or dishonest, or in a manner that seeks to achieve an unlawful or unfair purpose;

Use License
Higosense grants permission to temporarily download one copy of the materials on the Website for personal, non-commercial transitory viewing only, or for legitimate B2B evaluation purposes. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on the Website;
- remove any copyright or other proprietary notations from the materials; or

Marketing Materials and Trademarks
Marketing materials, including but not limited to brochures, presentations, images, videos, or any content describing Higosense or the Higo system, may not be used, reproduced, distributed, or displayed without our prior written consent.
To obtain a package of approved marketing materials, contact us at marketing@higosense.com. Any use of materials or information presenting Higosense or the Higo system requires prior approval via marketing@higosense.com. The procedure for obtaining consent is the same as described in the Business Partner Agreement, Section Marketing and Trademarks, which requires submission of a written request detailing the intended use, and approval must be granted in writing before any utilization. Unauthorized use may result in immediate termination of access and legal action to protect our intellectual property rights.

If Higosense becomes aware of a breach of the T&C, Higosense may immediately implement corrective actions, including disabling access to the Website as well as removing any information, data and content provided by the user on the Website at any time, to any extent and without notice. Any claims or disputes relating to the use of Website or a breach of this T&C shall be governed by the laws of the Republic of Poland without regard to its conflict of law provisions. Any claims and disputes shall be settled by the competent Polish common court, having jurisdiction over Higosense registered seat.

HigoSense Sp. z o.o. as a personal data Controller (hereinafter referred to as „Controller”) pays great attention to the protection of privacy and confidentiality of personal data of Users who make their data available in electronic form through forms available on the website in the domain higosense.com (hereinafter referred to as „higosense.com”), the rules of which are specified in the Terms of Use (hereinafter referred to as „Terms of Use”).

The Controller shall, with due diligence, select and apply appropriate technical and organizational measures to protect personal data being processed. Full access to databases is granted only to persons authorized by the Controller.
The Controller protects personal data against unauthorized access and processing in violation of applicable regulations.
Visitors to higosense.com can browse through subpages of the website without providing personal data.
Article 2. Grounds for processing personal data
Personal data shall be processed by the Controller in accordance with the law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as 'GDPR’).
Personal data are processed to:
- answer questions addressed to the Controller through the contact forms available on higosense.com website, including interactive windows available on each subpage of the website (according to article 6.1.f of the GDPR);
- dispatch of marketing content, including information about products, services, updates, or offers, on the basis of the consent (Article 6(1)(a) of the GDPR) or legitimate interests in B2B contexts (Article 6(1)(f) of the GDPR);
- establishing contact in order to prepare, at the Customer’s request, an offer of the Controller’s services and/or products tailored to the Customer’s needs (Art. 6.1.b of the GDPR),
- adapting and developing the website’s functionalities, including its structure and content to the needs of Internet users, creating aggregated statistics, and preserving the security and quality of services provided by the service – based on the legitimate interest of the Controller (Article 6(1)(f) of the GDPR);
- investigation or safeguard against possible claims (according to Article 6(1)(f) of the GDPR).
Regardless of the purpose of the processing, providing the data is voluntary, however, failure to do so may prevent, depending on the specific case, the conclusion of a contract, use of selected services within the service and its functionality or receipt of marketing content.
The User should not provide the Controller with personal data of third parties. In case of transfer of third parties’ data, the User is obliged to sign a declaration that s/he has the consent of third parties to transfer the data to the Controller.
Article 3. Scope of processing of personal data
The Controller processes personal data only to the extent necessary to achieve a strictly defined purpose, in accordance with the information indicated below:
- Sending a message through the contact form, among others: e-mail address and telephone number and all other information that the User will provide of his/her own free will in the addressed message;
- Sending marketing content: name and surname, e-mail address, telephone number, among others;
- Preparation of offers: name and surname, e-mail address, telephone number, and other information contained in the message sent through the contact form;
- Customization and development of website functionality: IP addresses collected during Internet connections for technical purposes related to server administration. The Controller does not make automated decisions on the basis of data collected about Users.
Article 4. Data retention period
Personal data shall be kept only for the time necessary to achieve the specific purpose for which it was transmitted or to ensure compliance, as set out below:
- Personal data collected for the purpose of answering questions asked via the contact form will be processed no longer than 12 months after the last contact;
- Data collected for the purpose of sending marketing content will be processed until the withdrawal of consent by the User or opt-out;
- Personal data collected for the purposes of preparing a personalized offer for products and/or services will be processed for the duration of the offer negotiation, and after its completion for 12 months counted from the date of the last contact, or they will feed the Controller’s customer database in order to execute the concluded agreement.
